Portable Property PDF
By:John Plotz
Published on 2008 by Princeton University Press

What fueled the Victorian passion for hair-jewelry and memorial rings? When would an everyday object metamorphose from commodity to precious relic? In Portable Property, John Plotz examines the new role played by portable objects in persuading Victorian Britons that they could travel abroad with religious sentiments, family ties, and national identity intact. In an empire defined as much by the circulation of capital as by force of arms, the challenge of preserving Englishness while living overseas became a central Victorian preoccupation, creating a pressing need for objects that could readily travel abroad as personifications of Britishness. At the same time a radically new relationship between cash value and sentimental associations arose in certain resonant mementoes--in teacups, rings, sprigs of heather, and handkerchiefs, but most of all in books. Portable Property examines how culture-bearing objects came to stand for distant people and places, creating or preserving a sense of self and community despite geographic dislocation. Victorian novels--because they themselves came to be understood as the quintessential portable property--tell the story of this change most clearly. Plotz analyzes a wide range of works, paying particular attention to George Eliot's Daniel Deronda, Anthony Trollope's Eustace Diamonds, and R. D. Blackmore's Lorna Doone. He also discusses Thomas Hardy and William Morris's vehement attack on the very notion of cultural portability. The result is a richer understanding of the role of objects in British culture at home and abroad during the Age of Empire.

Property for People, Not for Profit PDF
By:Ulrich Duchrow,Franz J. Hinkelammert
Published on 2004-09-04 by CIIR

The issue of private property and the rights it confers remain almost undiscussed in critiques of globalization and free market economics. Yet property lies at the heart of an economic system geared to profit maximization. The authors describe the historically specific and self-consciously explicit manner in which it emerged. They trace this history from earliest historical times and show how, in the hands of Thomas Hobbes and John Locke in particular, the notion of private property took on its absolutist nature and most extreme form--a form which neoliberal economics is now imposing on humanity worldwide through the pressures of globalization. They argue that avoiding the destruction of people's ways of living and of nature requires reshaping our notions of private property. It also examines the practical ways for social and ecumenical movements to press for alternatives.

Confiscation and Destruction PDF
By:Ugur Ungor,Mehmet Polatel
Published on 2011-06-09 by A&C Black

This is the first major study of the mass sequestration of Armenian property by the Young Turk regime during the 1915 Armenian genocide. It details the emergence of Turkish economic nationalism, offers insight into the economic ramifications of the genocidal process, and describes how the plunder was organized on the ground. The interrelated nature of property confiscation initiated by the Young Turk regime and its cooperating local elites offers new insights into the functions and beneficiaries of state-sanctioned robbery. Drawing on secret files and unexamined records, the authors demonstrate that while Armenians suffered systematic plunder and destruction, ordinary Turks were assigned a range of property for their progress.

Intellectual Property Law and History PDF
By:Steven Wilf
Published on 2017-07-05 by Routledge

Intellectual property has become a dominant feature of our knowledge based economy in recent years, but how has property rights in intangible items developed? This book brings together for the first time exemplary scholarship with diverse approaches to the history of United States intellectual property protection, including trade secrets, trademark, copyright, and patent law. These articles, written by leading experts in the field and often challenging conventional narratives, underscore the importance of historical perspectives for understanding how an extensive, evolving framework for the regulation of knowledge emerged in the modern period. By tracing intellectual property from an historical perspective - not merely providing justifications in philosophy or economics in the abstract - this book draws upon the past to address contemporary debates over such varied topics as: access to knowledge; policing copyright infringement; whether employees should own the products of their minds; the role of national borders in an age of digital information; and the very future of intellectual property as stakeholders and consumers contest the extent of its legal protection.

In Defense of Property PDF
By:Gottfried Dietze
Published on 1995 by University Press of America

In Defense of Property focuses on the importance of private property and its protection throughout history. Emphasizing the connection between property and propriety, Gottfried Dietze shows how the universal appreciation of property functions as an ethical institution, securing happiness under law and order. Dietze examines property rights within the general, civil rights complex and concludes that property rights, as the oldest officially recognized human right, must be considered on par with rights that came later. Following comments on the strong position of property rights in antiquity and the Enlightenment, In Defense of Property concentrates on developments in France, Germany, and the United States since the eighteenth century. Dietze describes the high degree of protection given to private property during the nineteenth century and the decline of that protection later. Dietze points out the risks of the decline of property rights and suggests ways to stop it. Originally published in 1963 by Henry Regnery Co.

Guidelines for Drafting and Editing Legislation PDF
By:Bryan A. Garner
Published on 2016-03-01 by Rosepen Books

This new Garner title consolidates into one set of covers all the best advice on legislative drafting. Garner elucidates his blackletter principles with statutory rewrites from all 50 states as well as from federal statutes. He demonstrates how legislation can be streamlined, simplified, and clarified. The exmaples show stunning improvements. Commissioned by the Uniform Law Commission, Garner's work here represents another in his string of first-rate reference books. No legislative drafter should be without it. In the back of the book are two model statutes plus a typically poor statute annotated to explain its deficiencies. Also included is a groundbreaking essay on the optimal method for expressing criminal prohibitions. Throughout the book appear shaded boxes containing timeless quotations from leading commentators on legislative drafting from the 18th century to the present day. Together the the book's extensive bibliography, these quotations place Garner's principles into a historical context. They also underscore the degree to which legislative drafters have neglected many long-standing principles of legal drafting. The foreward by Harriet Lansing, president of the Uniform Law Commission, says of Garner's work: |With these Guidelines--with his earlier booklet on court rules--Bryan Garner has made an incomparable contribution to clarity and coherence in the halls of our legislatures, the pages of our statute books, and the everyday world of all people as we try to plan our lives and predict legal consequences.|

Legal Writing for Legal Readers PDF
By:Mary Beth Beazley,Monte Smith
Published on 2014-10-14 by Wolters Kluwer Law & Business

Applying the perspective of the reader to the craft of writing, Legal Writing for Legal Readers teaches the differences between strong and weak legal writing by letting students read examples of both. Students discover how productive it can be to read a well-articulated argument, as compared to one that is illogical and ill conceived. We aren t always able to identify our own faults as writers but as readers, we can see clearly the merits of both the argument and its presentation. The authors sidebars and annotations highlight why one writer fails while another succeeds. Students realize the significance of their own behavior as readers and how that behavior should dictate their writing decisions. As readers, students learn to recognize the specific elements of analysis and structure that make legal writing effective. As writers, they will make better and more informed choices, when they think about it from a reader s perspective. Using the student s own experience as a reader to shed light on what makes legal writing succeed or fail, Legal Writing for Leal Readers features: A range of both strong and weak legal documents, selected to illustrate legal writing concepts Broad coverage that includes memos and briefs, as well as complaints, correspondence, and criminal motions Sidebar comments from the authors that provide context and insight Annotations that incorporate cognitive and behavioral theories to explain why some approaches work better than others Authors with a wealth of experience, in both teaching and practice

Robert Nozick PDF
By:Jonathan Wolff
Published on 1991 by Stanford University Press

Robert Nozick's Anarchy, State, and Utopia is one of the works which dominate contemporary debate in political philosophy. Drawing on traditional assumptions associated with individualism and libertarianism, Nozick mounts a powerful argument for a minimal |night-watchman| state and challenges the views of many contemporary philosophers, most notably John Rawls. This book is the first full-length study of Nozick's work and of the debates to which it has given rise. Wolff situates Nozick's work in the context of current debates and examines the traditions which have influenced his thought. He then critically reconstructs the key arguments of Anarchy, State, and Utopia, focusing on Nozick's doctrine of rights, his derivation of the minimal state, and his Entitlement Theory of Justice. Wolff subjects Nozick's reasoning to rigorous scrutiny and argues that, despite the seductive simplicity of Nozick's libertarianism, it is, in the end, neither plausible nor wholly coherent. The book concludes by assessing Nozick's place in contemporary political philosophy.
